Section 159
Complaints and action related to cases under this Act
 (1) In relation to any matter under this Act, a case can be filed and action can be taken only on the complaint of the office, director, officer, shareholder or member or creditor or any other interested person of the company.
(2) Unless it is clear that the office will take action in accordance with this Act, the court has the right to take action and rule on cases related to offenses that are punishable under this Act, matters that can be filed in court in various sections of this Act, and payment of wrongful compensation. will be.
(3) The court shall adopt the procedure of the Summary Procedure Act, 2028 while proceeding and disposing of the case in accordance with this Act.
(4) An appeal shall be taken within thirty-five days from the decision or order made by the office or the court under sub-section (2) to the court designated by the Government of Nepal with the consent of the Supreme Court.
(5) Notwithstanding anything written in sub-section (2), unless the Government of Nepal publishes a notice in the Nepal Gazette and appoints a court to deal with cases and other matters in accordance with this Act, the company board constituted under section 169 shall assume the jurisdiction of the relevant court under this Act.
(6) Unless the time limit for filing a complaint is specified in other provisions of this Act, no complaint shall be filed if the complaint is not filed within two years from the date of knowing the reason for filing a lawsuit in other matters under this Act.
